1.1 The competition is only open to residents in the UK aged 18 years or over. Kent Reliance employees are not eligible to enter. There is a limit of one entry per person, with one entry comprised of up to three photographs..
2. The prize
The prize is a £250 Amazon voucher and the display of the winning photographs in all of the Kent Reliance branches.
The Promoter reserves the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond the Promoter's control make it necessary to do so. No cash equivalent will be given.
The winner will be announced via Kent Reliance’s Facebook and Twitter accounts, and the winner will be notified by e-mail, the method in which they entered, and must provide a full name and postal address in order for the Promoter, if necessary, to send the prize to the Winner. The Winner will be notified within two weeks of the Closing Date.
The Promoter will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available, or has not claimed their prize within 30 days of the Announcement Date, the Promoter reserves the right to offer the prize to the next eligible entrant selected from the entries that were received before the Closing Date.
3. Winner announcement
The winner of the competition will be announced on Kent Reliance’s Twitter and Facebook social media platforms, and notified by email, by May 18, 2018 – two weeks after the Closing Date (“Announcement Date”).
The decision of the judges is final and no correspondence or discussion will be entered into. The Promoter does not accept any responsibility if the Winner is not able to take up the prize.
4. Limitation of liability
Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of participating in the competition or taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.
5. Ownership of competition entries and intellectual property rights
All competition entries and any accompanying material submitted to the Promoter will become the property of the Promoter on receipt and will not be returned.
The entrant warrants that they own all the intellectual property rights in all their submissions and that all entries are their own work and not that of a third party.
By submitting a competition entry and any accompanying material, the entrant agrees to:
(a) assign to the Promoter all intellectual property rights with full title guarantee; and
(b) waive all moral rights,
in and to your competition entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.
You agree that the Promoter may, but is not required to, make your entry available on its website and any other media, whether now known or invented in the future, and in connection with any publicity of the competition. You agree to grant the Promoter a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the competition entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the competition entry and any accompanying materials for such purposes.
The Winner shall indemnify the Promoter against all liabilities, costs, expenses, damages and losses (including but not limited to any direct, indirect or consequential losses, loss of profit, loss of reputation and all interest, penalties and legal costs (calculated on a full indemnity basis) and all other professional costs and expenses suffered or incurred by the Promoter arising out of or in connection with: any claim made against the Promoter for actual or alleged infringement of a third party's intellectual property rights arising out of or in connection with the use of the winner’s competition entries by the Promoter.
6. Data protection and publicity
If you are the winner of the competition, you agree that the Promoter may use your name, image and town or county of residence to announce the winner of this competition and for any other reasonable and related promotional purposes.
You further agree to participate in any reasonable publicity required by the Promoter.
By entering the competition, you agree that any personal information provided by you with the competition entry may be held and used only by the Promoter or its agents and suppliers to administer the competition.
If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude the entrant from participating in the competition.
The Promoter reserves the right to hold void, suspend, cancel, or amend the competition where it becomes necessary to do so.
These terms and conditions shall be governed by English law, and the parties submit to the exclusive jurisdiction of the courts of England and Wales.
The Promoter reserves the right to vary those Terms and Conditions where it becomes necessary to do so.
